Eligibility for Record Sealing & Expungement
Eligibility for record sealing in Florida is generally determined by the nature of your offense, your criminal history, and whether a judgment was entered against you. You may not be eligible for record sealing if you were found guilty, pled guilty, or pled no contest. Certain offenses, such as sexual misconduct, arson, and aggravated assault, may not be sealed.
Expungement eligibility is slightly more complex. You may be eligible for expungement in Florida if your record was sealed for at least 10 years, you were arrested but not convicted, or your charges were dismissed before trial. You cannot have been found guilty of any criminal offense, pled guilty, or no contest to any crime.
Under Florida, specific crimes cannot be sealed or expunged; these offenses disqualify you if a plea or verdict was made to the charge. As mentioned above, these offenses include those involving sex crimes, as well as drug trafficking and violent crimes, like arson, aggravated assault or battery, manslaughter, homicide, and more.
